dc.description.abstractThe advent of bench trials in common law jurisdictions is an epochal event as it presents existential challenges to the law of evidence. In this connection, the similar facts rule is an interesting case study as it allows scholars to understand the extent to which the similar facts rule is relevant to the bench trial context. As I will show, there are epistemic and moral reasons to retain the similar facts rule in the bench trial.
