Abstract: Many construction claims and disputes in the construction industry are frequently linked to delays (Kumaraswamy, Nadarajah, & Palaneeswaran, 2001). Therefore, it is common for all standard forms of contract to provide for extension of time clause for the purposes of allowing alteration to the completion date and for the Contractor to claim for all the associated costs as well as to preserve the rights of the Employer to deduct liquidated damages from the Contractor. Although both the Public Sector Standard Conditions of Contract (PSSCOC) standard form of contract as well as the Singapore Institute of Architects (SIA) Articles and Conditions of Building Contract contain detailed provisions regarding the notification given by the Contractor when event or events of delay occurs, it is difficult to foresee if the Contractor will comply with such condition precedent notice for EOT application. For that reason, this dissertation evaluates the effectiveness of the condition precedent notice for EOT with regard to the degree of compliance by the Contractor and lastly, to propose some recommendations that can improve the current notice requirement clause for EOT. To achieve the objectives, project information is obtained from industry professionals to carry out case studies analysis and the results showed that there is an increased prevalence of non-compliance with the condition precedent for EOT by the Contractor. Furthermore, the Architect and the SO also failed to comply with the in-principle response on the EOT entitlement within the stipulated notification period. Interviews were also conducted with industry professionals and the results show that improvement can be made on the condition precedent notice, especially on the notification period. With the help of this study, the draftsmen are provided with a specific direction to review and improve on the notice requirement clause for extension of time (EOT) in any standard forms of building contract.
