A REVIEW OF THE LAND TITLES (STRATA) (AMENDMENT) ACT

Abstract

The Land Titles (Strata) (Amendment) Act was revised in 2007 to inject clarity and transparency into the collective sale process. Public opinion was gathered in public consultations held in the months of April to May 2007 by the Ministry of Law that headed the revision committee.

This study hence attempts to analyze the effectiveness and impacts the new amendments have on collective sales. Information was gathered from both formal and informal sources as they provide a wider scope of opinions which may not have been presented at the public forum. The study found that the Land Titles (Strata) (Amendment) Act 2007 has been comprehensive in introducing new measures which offer a higher level of protection and more say to the minority owners in the collective sale process. However, the Land Titles (Strata) (Amendment) Act still remains silent on the issue of sales apportionment, and social problems such as harassment, and the loss of architectural heritage.
