Abstract: This dissertation seeks to analyse the differences between the SIA Articles and Conditions of Building Contract 9th edition (old SIA form) and the SIA Building Contract 2016 1st edition without quantities (new SIA form) and its implied impact on the Singapore construction industry. In addition, there is a current dissertation “Impacts of New SIA Building Contract 2016 on the Stakeholders in Singapore’s Construction Industry” carried out by Chua Yi Ting (2018) (“Ting (2018)”) touching on the topic of analysing the differences between the two forms. However, the author of this dissertation disagrees with certain ideas proposed by Ting (2018) and wishes to provide a more comprehensive comparison between the two forms which were left unaddressed. The dissertation will achieve the following objectives: - Compare topically the old SIA form and the new SIA form by choosing 3 topics that have significant changes but not yet addressed by Ting (2018). - Together with Ting (2018), provide a comprehensive comparison between the new SIA form and the old SIA form - Analyze the difference between the 3 chosen topics and its impact on the Singapore construction industry. - Propose recommendations to analyse the concurrent delay clause. - Propose recommendations to change the contract clauses that to better safeguard the interest of both parties involving in the contract form. This dissertation will identify three topics in the new SIA form that have significant changes from the old one but not yet addressed, which are Setting out and levelling proposal, Sequential and Concurrent Causes of Delay and Termination and Suspension by Contractor. Two research methodology are considered. First, a thorough literature review and law cases are conducted to understand the rationales behind each of the provision. Second, face-to-face interviews with experienced practitioners in the Singapore Construction industry, who can provide the real-world applications of the provisions, are also conducted.
