dc.description.abstractThis paper critically evaluates the ideal envisioned in Spandeck Engineering (S) Pte Ltd v Defence Science & Technology Agency of having a single test to determine the duty of care arising under the tort of negligence. It seeks to examine whether the Spandeck formulation has been consistently applied by the Singapore courts since 2007 and whether it is truly a universal test applicable to all scenarios and all kinds of damage.
